1. Acceptance of Terms

By downloading, installing, or using the Gym Beasts mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Gym Beasts ("we," "us," or "our").

2. Description of Service

Gym Beasts is a fitness gamification application that allows users to track workouts, level up personalized 8-bit beast characters, and achieve fitness goals through RPG-style progression mechanics. The App may include features such as workout tracking, progress visualization, achievements, and social elements.

3. User Accounts

3.1 Account Creation

You must create an account to use certain features of the App. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized use
  • Be responsible for all activities under your account

3.2 Age Requirement

You must be at least 13 years old to use Gym Beasts. Users under 18 must have parental consent.

4. Subscription and Payment

4.1 Subscription Plans

Gym Beasts may offer free and paid subscription plans. Subscription details, including pricing and features, are provided in the App and subject to change with notice.

4.2 Billing

  • Subscriptions are billed through the Apple App Store
  • Payment is charged to your Apple ID account at confirmation of purchase
  • Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage subscriptions and turn off auto-renewal in your Apple ID Account Settings

4.3 Free Trials

Free trial periods may be offered. If you do not cancel before the trial ends, you will be charged the subscription fee.

4.4 Refunds

Refunds are handled by Apple according to their policies. We do not process refunds directly.

5. User Conduct

You agree not to:

  • Use the App for any illegal or unauthorized purpose
  • Violate any laws, regulations, or third-party rights
  • Share false, misleading, or fraudulent information
  • Harass, abuse, or harm other users
  • Reverse engineer, decompile, or hack the App
  • Use automated systems to access the App (bots, scrapers)
  • Interfere with the App's operation or security
  • Upload malware, viruses, or harmful code
  • Attempt to gain unauthorized access to accounts or data

6. Health and Fitness Disclaimer

IMPORTANT HEALTH NOTICE:

  • Gym Beasts is a fitness tracking and gamification tool, not medical advice
  • Consult with a healthcare professional before starting any exercise program
  • We are not responsible for injuries or health issues resulting from app use
  • Do not use the App as a substitute for professional medical advice
  • Stop exercising and seek medical help if you experience pain, dizziness, or discomfort
  • The App's recommendations are general and may not suit your individual needs

7. Intellectual Property

All content in the App, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is the property of Gym Beasts or its content suppliers and is protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

8. User-Generated Content

If you submit content to the App (profile information, progress photos, reviews), you grant us a worldwide, royalty-free license to use, reproduce, modify, and display such content in connection with the App.

You represent that you own or have the necessary rights to any content you submit.

9. Disclaimers and Limitation of Liability

9.1 Warranty Disclaimer

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GYM BEASTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

10. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App will cease. You may also delete your account at any time through the App settings.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or via email. Continued use of the App after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your State/Country], without regard to conflict of law principles. Any disputes shall be resolved in the courts of [Your Jurisdiction].

13. Apple App Store Terms

If you downloaded the App from the Apple App Store, you acknowledge that:

  • You comply with applicable third-party terms when using the App
  • Apple and its subsidiaries are third-party beneficiaries of these Terms
